حکومت نے چوری شدہ گاڑیوں کی درآمد کو غیر قانونی قرار دے دیا فیڈرل ٹیکس محتسب نے فیڈرل بورڈ آف ریونیو کے کسٹمز اتھارٹی کی جانب سے چوری شدہ امپورٹڈ کاروں کو ٹرانسفر آف ریذیڈنس ، بیگیج سکیم ، یا گفٹ سکیم کے تحت کسی بھی قانونی دفعات پر عمل کیے بغیر، جرمانے اور ٹیکس کی ادائیگی پر غیر آئینی سمجھا ہے۔فیڈرل ٹیکس محتسب اسلام آباد نے ایک خود موشن انکوائری میں اس بات کا تعین کیا کہ 02.08.2006 کی اس وقت کی سی بی ار (ایف بی ار) کسٹم کانفرنس میں کیا گیا فیصلہ غیر آئینی تھا۔ ایف ٹی او کی تحقیقاتی کمیٹی نے اس بات پر زور دیا ہے کہ اس طرح کے فیصلے چوری شدہ گاڑیوں کی غیر قانونی درآمد کو فروغ دیں گے اور مناسب قانونی طریقہ کار کے بغیر بین الاقوامی مجرمانہ سرگرمیوں کو سہولت فراہم کریں گے۔ایف ٹی او نے اس تناظر میں فیڈرل ریونیو بورڈ کو نوٹس دائر کیے۔ ایف بی آر نے ایک رپورٹ فراہم کی جس سے ظاہر ہوتا ہے کہ 2007 اور 2013-2014 میں درآمد کی جانے والی گاڑیوں میں سے چھ اور تین کو سیالکوٹ اور پشاور کسٹم کلیکٹرز نے کلیئر کر دیا تھا۔ایف ٹی او نے ایف بی آر کو تجویز دی کہ تمام کسٹم کلیکٹرز اور دیگر اتھارٹیز فوری طور پر ان غیر قانونی اقدامات کو بند کردیں۔ کسٹم حکام نے فیصلہ کیا کہ چوری شدہ درآمد شدہ گاڑیاں یا تو واپس کی جائیں یا عوامی نیلامی میں ملک کے حکام کے حوالے کردی جائیں جہاں سے اخراجات کی ادائیگی کے بعد گاڑیاں لی گئیں۔کمیٹی نے یہ بھی تجویز کیا کہ ایف بی آر نے ایم سی سی کو ہدایت کی کہ وہ چھ گاڑیاں شناخت کرے اور ایسے مجرمانہ اداروں میں شامل درآمد کنندگان کو قابل قبول طریقے سے انصاف کے کٹہرے میں لائے۔ 45 دن کے اندر ایف ٹی او نے حکام سے رپورٹ پیش کرنے کو کہا۔ Import of stolen automobiles been declared illegal by the government The federal tax ombudsman has deemed unconstitutional the Federal Board of Revenue’s Customs authorities’ decision to clear stolen imported cars under the Transfer of Residence, Baggage Scheme, or Gift Scheme upon payment of redemption fines and taxes without following any legal provisions. The Federal Tax Ombudsman Islamabad determined in its motion inquiry that the choice made within the then CBR (FBR) Customs Conference of 02.08.2006 was unconstitutional. The Investigative Committee of the FTO has emphasized that such decisions will promote illicit imports of stolen automobiles and facilitate international criminal activities without proper legal procedures. The FTO filed notices to the Federal Revenue Board during this context. The FBR provided a report indicating that six and three of the automobiles imported in 2007 and 2013-2014 had been cleared by the Sialkot and Peshawar customs collectors. Also Read: FTO suggested to the FBR that each customs collector and other authorities involved should immediately discontinue these illegal actions. The Customs officials decided that the stolen import automobiles should either be returned or disposed of by public auction to the authorities within the country from which the vehicles were taken after expenses had been paid. The committee also suggested that the FBR instruct the MCC to require six vehicles identified and to bring the importers involved in such criminal enterprises to justice in a suitable way. Within 45 days the FTO asked the authorities to supply a report.
